2. Service Description

ThermaGenius provides lead generation services to qualified businesses. Our platform connects businesses with potential customers through advanced targeting and verification processes. We deliver qualified leads based on specific criteria agreed upon during the qualification process.

3. Qualification Process

Access to our lead generation services requires qualification through our sales team. Not all applicants will be approved for our services. We reserve the right to accept or decline service requests at our sole discretion based on business compatibility, industry requirements, and service capacity.

4. Pricing and Payment

Our services are priced per qualified lead as outlined on our pricing page. Pricing may vary based on targeting complexity, industry, and service level selected. Payment terms will be established during the qualification process and outlined in your service agreement.

• Standard Leads: $40 per qualified lead
• Premium Leads: $50 per qualified lead
• Enterprise Leads: $60 per qualified lead

Prices are subject to change with 30 days notice to existing clients.

5. Lead Quality Guarantee

We guarantee that delivered leads meet the agreed-upon criteria including verified contact information and demographic targeting. If a lead fails to meet our quality standards, we will provide a replacement lead at no additional cost. This guarantee does not extend to conversion rates or sales outcomes.

6. Data Privacy and Protection

We are committed to protecting the privacy and security of all data processed through our platform. Lead data is collected through legitimate means and in compliance with applicable privacy laws. Clients are responsible for their own compliance with privacy regulations when contacting provided leads.

7. Prohibited Uses

You agree not to use our service for:

• Illegal activities or purposes
• Spam or unsolicited mass communications
• Harassment or abusive contact practices
• Violation of privacy laws or regulations
• Resale or redistribution of lead data

8. Intellectual Property

The ThermaGenius platform, including all content, features, and functionality, is owned by ThermaGenius and protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works without express written permission.

9. Limitation of Liability

ThermaGenius shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of the service.

10. Service Availability

We strive to maintain high service availability but do not guarantee uninterrupted access. We reserve the right to modify, suspend, or discontinue the service at any time with reasonable notice to active clients.

11. Termination

Either party may terminate the service relationship at any time with written notice. Upon termination, you will remain responsible for any outstanding payments for services already provided.

12. Governing Law

These terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes arising from these terms shall be resolved in the courts of Texas.

13. Changes to Terms

We reserve the right to modify these terms at any time. Changes will be effective immediately upon posting to our website. Continued use of the service after changes constitutes acceptance of the new terms.
